Common Myths and Mistakes in Personal Injury Cases

They include:

Assuming your injuries are minor and/or will heal on their own.  It’s very common for an accident victim to feel okay shortly after an accident, only to feel much worse days or weeks later.  We also commonly see injuries linger for months or even years.  In short, do not assume your injuries are minor or will resolve over time.

Failure to get medical attention.  Related to number one above, it’s incredibly important to get professional medical treatment immediately after the incident… and also to continue that treatment as necessary until the matter is resolved.  This creates a record that will be critical when negotiating with the insurance company.

Talking to an insurance company without legal representation.  While insurance companies are supposed to payout on legitimate injury or wrongful death claims, they often do not.  In fact, their profitability depends on paying out as little as possible in these types of cases.

You need a large law firm. The great majority of personal injury cases don’t require an “army of lawyers” as larger firms would like you to believe, but rather one that is completely invested in his client’s right to compensation for damages.

Accepting too small of a settlement.  While it’s very easy to accept a settlement offer from an insurance company when the car needs repaired or medical bills are piling up, it’s more important to recognize that expenses may increase significantly over time.  In other words, do not accept a settlement offer until you have spoken with a professional who can calculate the future economic needs of all persons involved.
